This is now called without notice. It most commonly refers to emergency hearings that are conducted with only the applicant present at court. If the court makes an order at the without notice hearing, the judge will ensure that another hearing can be held quickly afterwards in order to hear the respondent’s case and then make a final order. Often without notice hearings are used to deal with injunctions i.e. to prevent the other party from doing something.
