A regular payment of money by one spouse to another under a court order or following an agreement. Spousal maintenance refers to maintenance paid from one spouse to another. It is possible to capitalise spousal maintenance by the payment of a lump sum to achieve a clean break. Maintenance can be secured on the assets of the paying party if there is a risk that the order may be breached. Those assets can then be sold to ensure the recipient’s claim is satisfied.
